Thief Arrested

OROVILLE CA NEWS -- This chick, Jennifer Diane
Maynard, has been arrested for a felony warrant charging her with
auto theft and evading a peace officer with wanton disregard for public
safety.

Typically, the charge of vehicle theft is felonious in
California when the vehicle stolen is clearly, distinguishably, modified
for the disabled, an ambulance, a marked police car, fire truck or other emergency response
vehicle on an emergency call as interpreted from Chapter 4, Division 4, Section 10851(b),
of the California Vehicle Code (CVC).
Evading a peace officer in California becomes
felonious when reckless driving occurs as described in the CVC Chapter 4,
Division 2, 2800.2. and none of California Penal Code § 17 applies.
2800.2. (a) If a person flees or attempts to elude a pursuing peace
officer in violation of Section 2800.1 and the pursued vehicle is driven in a willful or
wanton disregard for the safety of persons or property, the person driving the vehicle,
upon conviction, shall be punished by imprisonment in the state prison, or by confinement
in the county jail for not less than six months nor more than one year. The court may
also impose a fine of not less than one thousand dollars ($1,000) nor more than ten
thousand dollars ($10,000), or may impose both that imprisonment or confinement and
fine.
(b) For purposes of this section, a willful or wanton disregard for the safety of
persons or property includes, but is not limited to, driving while fleeing or attempting
to elude a pursuing peace officer during which time either three or more violations that
are assigned a traffic violation point count under Section 12810 occur, or damage to
property occurs.
A violation of § 2800.2 can be either a felony or a misdemeanor.
Whether a violation is treated as a felony or a misdemeanor is
controlled by California Penal Code § 17. A crime that is punishable by
imprisonment in the state prison is a felony unless section 17(b) is applicable. There
are five qualifying subsections under section 17(b), which if none of are applicable in a
case, the violation is a felony.
So home girl, Jennifer Diane Maynard, when caught faces time, and is
now the run. Accused of committing a serious crime, she is considered a
menace to society.
