U.S. - MEXICO NEWS -- Friday, May 15, 2009, in sunny downtown San Diego, California, United States Attorney Karen P. Hewitt announced the unsealing of a three-count superseding indictment charging Jesus Navarro-Montes with federal narcotics violations and second degree murder in connection with the death of United States Customs and Border Protection Border Patrol Agent Luis Aguilar on January 19, 2008. Navarro-Montes is currently in the custody of Mexican law enforcement authorities in Mexico after the FBI and U.S. Customs Border Patrol offered a combined reward of $350,000 for his arrest. Tips ultimately, lead federal officers with Mexico's Agencia Federal de Investigacion, in an operation coordinated with the FBI and the United States Marshals Service to Jesus Navarro-Montes' arrest, which was initially for a San Diego federal grand jury indictment alleging that Navarro-Montes had possessed with intent to distribute approximately 445 kilograms of marijuana on September 23, 2007.

According to additional superseding indictment, handed up by a federal grand jury sitting in San Diego on May 6, 2009, and was unsealed Friday, CBP Agent Aguilar was on duty on January 19, 2008, in the Imperial Sand Dunes Recreation Area in Imperial County, California, when he was struck and killed by a Hummer H2 driven by Navarro-Montes. The superseding indictment further alleges that Navarro-Montes conspired to distribute marijuana beginning at a date unknown and continuing up to and including January 19, 2008. Additionally, he superseding indictment replaces the initial indictment for intent to distribute approximately 445 kilograms of joy-smoke.

$350,000 Reward for Mexican - Captured!

On March 30, 2009, the United States requested Navarro-Montes' extradition from Mexico on the original narcotics charge. Now, they will be asking for Navarro-Montes to answer for additional alleged second degree murder charges.

United States Border Patrol Agent Luis Aguilar was killed in the line of duty attempting to stop suspected smugglers believed to have entered the United States illegally. Agent Aguilar was struck and killed while deploying a controlled tire deflation device to stop two vehicles driven by the suspected smugglers. After striking the Border Patrol agent, both vehicles escaped into Mexico. Luis Aguilar, was a 32-year-old father and Senior Patrol Agent assigned to the Yuma, Arizona Border Patrol Station and was working near Andrade, California, which is located about twenty miles west of Yuma, Arizona
