Wanted by the FBI for FTA - Mortgage Fraud

DALLAS TX NEWS -- Xuyen Thi-Kim Nguyen, a female white collar criminal, has been most wanted since February 3, 2006, for failure to appear (FTA). Apparently, Nguyen was placed on home monitoring while awaiting her sentencing, but instead decided to flee her home in Plano, Texas, sometime between November 8, 2005, and November 11, 2005. Nguyen was convicted of one count of conspiracy, two counts of mail fraud, and seven counts of fraud by wire, and was facing imprisonment and paying restitution in the millions of dollars for her involvement in a mortgage fraud scheme. In fact, Nguyen's coconspirators all received prison terms up to 60 months and were ordered to pay millions of dollars in restitution.

According to a May 2005 grand jury indictment, Xuyen Thi-Kim Nguyen along with six other individuals:

  • Sean Cung-Kim Nguyen
  • Dai Quoc Nguyen
  • Tam Nguyen
  • Myna Tran
  • Hong Thanh Duong
  • Cuc Kim Tran

Were all charged with crimes that involved a mortgage fraud scheme to defraud Countrywide Home Loans, d/b/a America's Wholesale Lender (Countrywide). The scheme resulted in millions of dollars worth of losses to Countrywide due to fraudulent mortgage loan applications and appraisals for residential home purchases in the DallasFort Worth Metroplex. Furthermore, the defendants allegedly conspired with a real estate appraiser, Gandhi Ben Morka of Arlington, Texas, who was also later indited and convicted for his role in the mortgage fraud scheme to defraud Countrywide. Morka would prepare appraisals on properties, inflating the value properties in most cases to double the fair market value. Xuyen Thi-Kim Nguyen and the other conspirators would then find straw purchasers, (a purchaser who is knowingly acquires an item for someone who is unable to complete such a transaction themselves), for which they would prepare and submit fraudulent loan applications to secure a mortgage loan for the targeted single-family residences in an amount that was substantially greater than the fair market value or real value of the home. Countrywide would then fund the inflated loans, based on those false and fraudulent misrepresentations. Once receiving the funds from Countrywide, Nguyen and her co-conspirators would pay the original owners of the properties and distributed the remaining fraudulently obtained loan proceeds among themselves. As a whole, the criminals conspired together to steal money from Countrywide on more than 18 different real estate transactions amounting to more than $5 million in theft.

Xuyen Thi-Kim Nguyen was born in Vietnam, and became a naturalized citizen in 1999. She has lived in the Seattle, Washington, and Dallas, Texas. She speaks fluent Vietnamese and is described as having a very bad case of ugly. Nguyen is further described as:
